Acceptance of Terms

By accessing and using the services provided by Shane Kerr Music ("we," "our," or "us"), you accept and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

Services Provided

Shane Kerr Music provides live music entertainment services for various events including:

  • Weddings and engagement parties
  • Corporate events and functions
  • Private parties and celebrations
  • Pub, club, and restaurant performances

Booking and Payment Terms

Booking Confirmation

All bookings are subject to availability and must be confirmed in writing via email or signed contract. A booking is only considered confirmed once:

  • A deposit has been received (typically 30-50% of the total fee)
  • A booking contract has been signed by both parties
  • Written confirmation has been provided

Payment Schedule

  • Deposit: Required to secure your booking date (non-refundable)
  • Final Payment: Due 7 days before the event date
  • Accepted Methods: Bank transfer, cash (by arrangement)

Pricing

Quoted prices are valid for 30 days from the date of the quote. Prices may be subject to change based on:

  • Travel distance beyond standard service area (200km from Cowra)
  • Special equipment requirements
  • Extended performance hours
  • Additional services requested after initial quote

Cancellation and Refund Policy

Client Cancellations

  • More than 90 days before event: Deposit refunded minus $100 administration fee
  • 60-90 days before event: 50% of deposit refunded
  • 30-60 days before event: 25% of deposit refunded
  • Less than 30 days before event: No refund; full payment required

Force Majeure

In the event of circumstances beyond our control (e.g., extreme weather, illness, natural disasters, government restrictions), we will:

  • Attempt to provide a suitable replacement performer
  • Offer to reschedule to a mutually agreeable date
  • Provide a full refund if rescheduling is not possible

Performance Conditions

Venue Requirements

The client/venue must provide:

  • Safe and weather-protected performance area (for outdoor events, covered area required)
  • Access to power outlets (unless battery PA system is specified)
  • Parking space for equipment loading/unloading within reasonable proximity
  • Secure area for equipment storage during breaks (if applicable)
  • Adequate lighting for evening performances

Performance Times

  • Standard performance packages include specified set times with breaks
  • Setup time (30-60 minutes) and pack-down time (30 minutes) is additional to performance time
  • Extensions to performance time beyond the agreed schedule are subject to availability and additional fees
  • Timeline changes on the day may be accommodated where possible but cannot be guaranteed

Liability and Insurance

Shane Kerr Music carries public liability insurance. We take all reasonable precautions to ensure safety during performances, however:

  • We are not liable for damage to venue property caused by guests or third parties
  • Equipment is insured, but clients are responsible for providing secure storage areas during events
  • We reserve the right to cease performance if venue conditions become unsafe
  • Clients are responsible for obtaining necessary permits/licenses for events

Intellectual Property

All original music, arrangements, and creative content performed by Shane Kerr Music remain the intellectual property of Shane Kerr. Clients may:

  • Record performances for personal, non-commercial use
  • Share personal recordings on social media with appropriate credit

Professional recording or commercial use of performances requires prior written permission.

Content and Conduct

We strive to provide family-friendly entertainment suitable for all ages. We reserve the right to:

  • Refuse requests for inappropriate material
  • Cease performance if subjected to abuse, harassment, or threatening behavior
  • Modify setlist based on audience and venue appropriateness

Modifications to Services

While we accommodate reasonable requests for changes to agreed services, significant modifications requested within 14 days of the event may incur additional fees or may not be possible. We recommend finalizing all details at least 2 weeks before your event.

Dispute Resolution

In the event of any dispute arising from these terms or our services, both parties agree to first attempt resolution through good-faith negotiation. If negotiation is unsuccessful, disputes will be resolved in accordance with the laws of New South Wales, Australia.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Bookings confirmed prior to term changes will be honored under the original terms.
